Trump will be convicted by international Courts after losing elections

He tries to mock on International Court (sanction) & now Tit for Tat will come 

 

Premise:  Trump is committed to WW3: prove abound  (case Syria, Iran, CH, RU, Ven)  

 

Legal Problem:

1-There are international covenants (agrements) to PREVENT WORLD WARs (Geneva Convention)

2-IF WAR IS  inevitable: there are 3 types of rules to be respected:

 

1- BEFORE  WAR: ‘JUS AD BELLUM’ = This is also called CRIMES of PEACE  and refer 4principles or requirements before initiating war:

a-Proper authority; Besides the Executive, the Senate or Congress plus the Supreme Court mast agreed. Then the public declaration of war is set. It must stated clearly the beligerant zones and respect the neutrality of adjacent or neighboring countries that decide so.

b- Just cause: implies finishing the mediation-reconciliation effort made by International Court delegates to settle agreement for peace.  

c- Right intent: means C-1 to discard the use & abuse of  super-military power by one of the contenders.  Right intent is the opposite to military aggression. C-2 It also exclude the uses of People armed insurrection against opposite political ruler elected democratically. C-3 It also exclude the uses of paid foreign mercenaries to attack an elected ruler. C-4 It exclude the brutal uses of violence by pólice and military armed and/or directly supported by foreign countries. (Case: US-Plan Condor in Chile Agst Allende or US-Col mercen Aghst VEN).  C5- The pilling & use of chemical & biological weapons against peaceful protesters in streets and/or Agst foreign enemies, is not right intent. In all these case there is not right intention  but imperial terrorist intention.   

d-Peaceful end:  The purpose of all negotiation before war, during war and after it, is to achieve PEACE. Any threat of war and the manufacture & use of lethal weapons is the opposite of peace. That has to be denounced in Court as intention of war & genocide or as war-crime in process. The pilling of weapoms is only justified for self -defense IF and only IF proved that the ‘enemy ‘ is already armed & making threats of war. In this case ARMING THE PEACE is legal and much better if dismantle nuke is achieved peacefully.

2. DURING WAR: “JUS IN BELLO” It includes 2 Principles: Proportionality and Discrimination..  plus part of Crimes Agst Humanity  and War Crime

a- Proportionality implies that the means of violence to be used  during  war must be limited to the purpose at hand and the space to be covered with them.  Neighboring cities and countries  should no be affected by bombs. A thermo nuclear bomb can’t be used a small country. Bombs should not be used at all .. because any atomic bomb cannot  discriminate between civilians & soldiers.

Proportionality also prohibit the uses of chemical and biological bombs, its effects damage DNA of soldiers & civilian who inhaled or eat the contaminated plants or roots. These bombs affect DNA and its effect can be transmitted  from one to next generation.

b- Discrimination is the 2^nd major principle of JUS IN BELLO. It suggest that belligerents should discriminate between combatants and non-combatans and that noncombatants must be protected

c-Crimes Agst Humanity and War Crimes. The international Military Tribunal at Nuremberg said that these are severe crime in addition to crimes against PEACE (2.1)

C.1 Crimes Agst Humanity. Namely:  murder, extermination, enslavement, deportation and other inhuman acts committed against any  civilian population before and during war. It also includes persecusions on political, racial  or religious grounds, whether o not are in violation of the domestic Law of the country who perpetrated.

C.2 War Crimes: It includes all of the above but during war  and occupation by foreign soldiers. It adds the criminal treatment of prisoners of war, the plunder of private property, the wanton destroy of cities, towns or villages as happen in Syria right now, plus other types of devastation not justify by military necessity.  (von Glahn, 1970). Now T know what is waiting for him if he use mega-bomb to destroy & invade China.

3.1 CRIMES AGAISNT HUMANITY : racist terrorism on blacks, latinos ++

3.2 WAR CRIMES: in several countries directly  & via ISR in PAL n M-East

3.3 VIOLATING 4 BASIC PRINCIPLES OF ‘JUS AD BELLUM’ :  BEFORE WARS

a-Proper authority.  Case Syria, Venezuela  & now Iran + Afganistan

b- Just cause. No mediation-reconciliat, just bombs, blockage n sanctions

c- Right intent: No right intentions, just imperial-terrorist intentions

d- Peaceful end: War is the main business of Trump regime & now dreams CH
